ORDER 1. We think the discharge was right. A person who answers questions put to him by a Police officer making an investigation under Section 161 of the Code of Criminal Procedure does not institute or cause to be instituted criminal proceedings within the meaning of Section 211 of the Indian Penal Code, nor does he thereby charge any person within the meaning of that section.
