JUDGMENT Maclean, C.J. - We are unable to agree with the view taken by Gupta, J. We think the estate of the husband is still unadministered and the Appellant is entitled to administration de bonis non to that estate. We fail to see on what principle the learned Judge in the Court below held that she was entitled to administration to the son's estate. There are reasons given in that judgment with which we are unable to agree. The order of the lower Court will be discharged and order in the prayer of the petition will be granted.
