JUDGMENT 1. In this case the acting Chief Presidency Magistrate has revived a case which had been dismissed and transferred it for trial to a Bench of Honorary Magistrates after process had been issued against the accused person. At the hearing a preliminary objection was taken by the learned pleader who appeared for the Defendant to the effect that the Magistrate had no power to revive the case and to transfer it to the Bench of Honorary Magistrates for hearing. On that the Honorary Bench have referred to us the question whether they had jurisdiction to entertain that preliminary objection. 2. In our opinion the question must be answered in the affirmative. They had jurisdiction to entertain the objection which was raised at the hearing before them, but we think it right to observe that the objection which was raised appears to be met by the decision of a Full Bench of this Court in the case of Dwarka Nath Mondal v. Beni Madhub Banerjee 5 C.W.N. 457 : S.c. ILR 28 Cal. 682 (1901) and decided in February, 1901.
