JUDGMENT : Blair, J.: This appeal must obviously be allowed. The Court below has applied section 10 of the Limitation Act, and held that there was no limitation for the suit as brought against the defendant-No. 3. It is obvious to my mind that the scope of section 10 deals with a state of things wholly different from the relation between the parties created in this case by one person leaving money in the hands of another to be given to a certain third person. 2. It is enough to say that there never was a vesting of the property in the person to whom the money was given, nor was the suit one for the purpose of following the property in the hands of the person in whose possession it was within the meaning of section 10 of the Limitation Act, That being so, article 62 of section II of the Limitation Act applies, and this suit was beyond time, and as far as the defendant No. 3 is concerned, the suit is dismissed. The appeal is decreed with costs in all courts.
