JUDGMENT : AIKMAN, J. 1. The applicant, Jugal Kishore, who is found by the Court below to be of unsound mind, brought a suit through his next friend Gokul Chand, to recover from the defendant money due under a bond, purporting to have been executed by the defendant in favour of the plaintiff. The defendant pleaded that the plaintiff was not of unsound mind, and further denied execution of the bond. Both the issues were found against the defendant by the Judge of the Small Cause Court. The learned Judge, how-ever, dismissed the plaintiff's suit because in his opinion the contract was void, as the plaintiff was held by him to have been of unsound mind at the time when the bond was written. 2. Even if the contract was void, that was no reason why the defendant should not pay the money which he borrowed from the plaintiff. See section 65 of the Contract Act. Under section 25 of the Provincial Small Cause Courts Act, I set aside the decree of the Court below, and decree the plaintiff's suit with costs here and in the Court below. This decree is ex-parte as the defendant is not represented.
