JUDGMENT : Knox, J. On 26th November, 1903, it was brought to the notice of the respondent's counsel that there was a deficiency in the fees paid by his client who was appellant in the court below. Under section 12, clause 2 of the Court-Fees Act, he was required to pay the additional fee. 2. Time has been repeatedly given. On the last occasion a Bench of this Court ordered. “No more time should be allowed.” The fee has not been paid in. The result is that the appeal to the court below must be and it hereby is dismissed. The result is that this appeal succeeds, the decree of the lower appellate court is set aside with costs, and that of the court of first instance is restored, The appellants will have the costs of this appeal.
