ORDER Munro, J. 1. All that is shown is that the accused marched the prisoner by night. There is no evidence that they had any reason to expect that any attempt would be made at a rescue, and I do not think an offence under Section 223 is made out The conviction is set aside and the accused are acquitted. The fine, if paid, will be refunded.
