JUDGMENT 1. We agree with the Judge that the suit is barred by Section 244, Civil Procedure Code (Act XIV of 1882). 2. But we think the plaint may be treated as an application for delivery. 3. We, therefore, set aside the decrees of the Courts below, direct the Munsif to treat this as an application within Section 2-ft of Act XIV of 1882 and dispose of it in accordance with law. 4. Costs will abide and follow the result.
