JUDGMENT : 1. We are quite satisfied that the lower appellate Court intended to find and did find that the Sale made to the plaintiff was made with the full consent of both the brothers. Upon this finding the decree of the lower appellate Court was correct, and the decree of the learned Judge of this Court was not correct. 2. We accordingly allow the appeal, set aside the decree of this Court and restore the decree of the lower appellate Court with costs of both hearings in this Court.
