JUDGMENT : Ryves, Piggott, JJ. In our opinion this case is covered by an authority of this Court in Maharaj Tewari v. Har Charan Rai, (1903) I.L.R., 26 All., 144. This case was followed in Jhingai Singh v. Ram Partap, (1908) I.L.R., 31 All., 150. We entirely agree with the view expressed in both these cases. We accordingly dismiss this application.
