Lord Moulton:— Their Lordships have had the case on behalf of the Appellant very fully and forcibly put before them, and their attention has been called to the judgment of the Judge at the trial, and to the judgment of the High Court in its appellate jurisdiction. They are of opinion that the latter judgment, from which this Appeal is brought, is a judgment based upon proper principles and upon a due appreciation of the evidence in the case, and they can see no reason for differing from it. They will therefore humbly advise His Majesty that the appeal ought to be dismissed, and the appellant must pay the costs. Appeal dismissed.
