JUDGMENT 1. We are not satisfied that any question of the exercise of jurisdiction illegally or with material irregularity arises in this case. But it is said that Prosunno having entered into a compromise it was not open to him to file a cross-appeal. It was not contended apparently before the District Judge that Prosunno was estopped. We do not think that he was estopped from taking the argument which was accepted by the District Judge, namely, that if the sale is set aside at all it must be set aside in its entirety. 2. The Rule is discharged with costs, hearing fee one gold mohur.
