JUDGMENT : KNOX, A.C.J.:— I agree with what was said by Mr. Justice BURKITT in Queen-Empress v. Ajudhia, [1898] I.L.R., 20 All., 339.. The genera] rule in a case of this kind should be that before an order of this nature is made to the prejudice of an accused person notice should be given to that person to appear and show cause why the order should not be passed. 2. I set aside the order of the District Magistrate and I direct that if he thinks it necessary to take any further action in this case he will do so after giving notice to the accused. Let the record be returned.
