JUDGMENT 1. In our judgment this is a case which is out of the ordinary, and although the matter depends upon the question of fact we accept the reference for the reasons stated by the learned Sessions Judge and consequently set aside the conviction of and the sentence passed upon the two accused. The fine, if paid, must be refunded.
