Viscount Cave :- This is a pure question of fact on which the Chief Court of Lower Burma has found in favour of the respondents. In coming to their conclusion the court appears to have had regard to the test or rule as to adoption which was laid down in, two cases before their Board, Ma Me Gale v. Ma Sa Yi. 32 I. A. 72, and Ma Ywet v. Ma Me. 36 I. A. 192. Both cases having been followed in the later case, decided by this Board, of Maung Thwe v. Maung Tun Pe. 44 I. A. 251.After listening to all that has been said by counsel for the appellants their Lordships do not think the suggestions put forward are sufficient to shake the conclusion of fact arrived at by the Chief Court of Lower Burma on the whole of the evidence, and accordingly they will humbly advise His Majesty that these appeals be dismissed with costs. Appeals dismissed.
