JUDGMENT Lindsay, J. - I have read the order of the learned Sessions Judge and agree with his view of the case. I, therefore, set aside the order of the Magistrate, as recommended by him, and direct that the case be sent back to the Magistrate, who will proceed to appoint a fresh jury and decide the matter under the provisions of Section 139 of the Code of Criminal Procedure.
