JUDGMENT Grimwood Mears, C.J. and Piggott, J. - The point taken on behalf of the plaintiff appellant is an ingenious one and, no doubt, entitled to consideration; but we are satisfied, on the whole, that the ruling referred to by the learned Judge of this Court does govern the present case and that the decision under appeal was correct. 2. We dismiss this appeal with costs.
