JUDGMENT Kendall, J. - This is an appeal from the order of the Subordinate Judge of Ghazipur sending a suit back to the Court of the Munsif of Ghazipur for trial de novo. The suit was originally filed in the Court of the Munsif of Ghazipur but was transferred by the District Judge to the Munsif of Saldpur, who had no territorial jurisdiction to try it. It was nevertheless disposed of by the Munsif of Saidpur, but on appeal the Subordinate Judge set aside the decree and order on the ground that the trying court had no jurisdiction to entertain the suit. 2. In passing his order the learned Subordinate Judge was relying on a decision of this Court, viz., the case of Ram Das v. Habib Ullah (1931) 1931 A.L.J. 1061 : 136 Ind. Cas. 384, but that decision has since been reversed and in the case of Kishore Lal Vs. Balkishan, AIR 1932 All 660 it has been decided that a District Judge has power to transfer a suit pending in one subordinate court to another subordinate court which has pecuniary but no territorial jurisdiction to try that suit. This was the case here and in accordance with this later decision the Munsif of Saidpur was by the order of transfer vested with jurisdiction to dispose of the suit. The result is that the appeal is allowed with costs, the order of the lower appellate court is set aside and the decree and order of the munsif are restored.
