JUDGMENT 1. This is an application lo confirm the report of the Official Referee. I have already dealt with the material facts in the judgment which I delivered last week upon the exceptions to the report. [His Lordship after giving certain directions proceeded.] 2. The Only question which remains is the costs of the reference which I am told extended over some 42 sittings some of them being for two hours some for three hours and some for 3 1/2 and I think one or two for four hours. What I propose to do with regard to the costs of the reference is to direct the Taxing Officer to add up the number of hours spent over the reference and to divide them by 4. The number then arrived at will represent the number of attendances to be allowed for the purpose of taxation. The Defendant will be entitled to the costs of the reference to be calculated on this footing and the costs will include the application to confirm the report. Mr. Justice Costello concerned.
