ORDER Lakshmana Rao, J. 1. The view of the Joint Magistrate is untenable and he has no power to award costs in applications under Section 528 of the Code of Criminal Procedure. 2. The reference is therefore accepted and the order as to costs is set aside. The amount if levied will be refunded.
