JUDGMENT Thomas, C.J. - The word "capitalists" is rather a vague phrase to denote a definite and ascertainable "class' so as to come u/s 158-A of the Indian Penal Code. But where a person compares the taluqdars and the zamindars as a class and the money-lenders and the Government officials with tenants and states that the Government officials do not sympathies with their aims and excites the tenants to organize themselves as their Raj was coming in which the taluqdars and zamindars will have no share and that the taluqdars have deceived and betrayed the country into the hands of, the British Government, the case is covered by S. 153-A.
