The appeal was presented on 2nd July 1940, and the should not have been disposed of the same day in spite of the request of the advocate for time to obtain the necessary records. The order of the Sub-divisional Magistrate is therefore set aside and the appeal is remanded to the Sub-divisional Magistrate of Musiri for disposal according to law.
