JUDGMENT Lakshmana Rao, J. 1. The reference is accepted. The order of the Stationary Sub-Magistrate of Kadiri dated 16 February 1940 and made in P.R.C. No. 3 of 1940 is set aside and he is directed to return the complaint to the complainant for presentation to the proper Court.
