When a mortgage in favour of A and B is superseded by another mortgage in favour of A alone, the second debt is not in favour of the same creditor as the first and ban not be treated as a renewal, for the purpose of the explanation to Section 8, Madras Act, 4 of 1938, The appeal is dismissed with costs.
