1. This case relates to Matmi of 39 bighas and 5 biswas of land situated in jagir village of Suratpura, Tehsil Lalsot. This land was a State-grant of the former Jaipur State to the temple of Shri Mahadeoji and sewa-puja was done by Suraj Mal Pujari who managed the land for the benefit of the temple. 2. An enquiry was held about this grant on a mukhbiri application and the Deputy Commissioner recommended that matmi of this land be sanctioned in favour of Surajmal but the Board of Revenue of the former Jaipur State refused matmi on the ground that no matmi had taken place in the past and it was not the policy to sanction matmi in the names of new pujaries and, therefore, ordered that the land may be resumed. Against this order Surajmal filed a review petition before the Revenue Minister of the Jaipur State who sent the case back to the Revenue Board. The Revenue Board again re-iterated their former decision and dismissed his application. It is against this order of the former Board of Revenue of the Jaipur State that this review application has been filed. It is argued by the counsel for the applicant that the Board of Revenue took no notice of the fact that the grant was in the name of the temple and so long as the temple existed and its sewa-puja was regularly performed the grant could not be resumed. This mistake is apparent on the face of the record and the review should, therefore, be accepted. 3. We feel there is much force in this argument. The grant was admittedly in the name of the temple and the temple does exist and the petitioner was performing its sewa-puja and merely because matmi had not been done in the past the grant could not be resumed. The policy of the State was one thing and the law under which the grant could be resumed was another. Since there was no such law for resumption of such grants we consider that the order of the Board for resuming this land was erroneous. We, therefore, set aside that order and hold that the land should continue to remain in the name of the temple and Surajmal may continue to hold the land as trustee of the temple.
