The point for decision here is whether in this review petition filed after the new Court Fees Act came into force the court-fee payable is at the rate prevailing under the old Act when the appeal was filed or whether court-fee should be paid at the new enhanced rate. Though there is conflict of opinion on the point the view that commends itself to us is that taken in I.L.R. 50 Mad. 488 that court-fee at the enhanced rate in force on the date of the presentation of the review petition is the proper fee leviable. Ordered accordingly. Time for payment two weeks.
