Judgment.- In this appeal the point raised is that the distribution made by the Commissioner in respect of the compensation awarded by him between the dependants is not proper. The widowed mother has been given the sum of Rs.450. Whereas twice that amount, viz., Rs.900 has been set apart for the widow of the deceased and his minor son. Learned counsel urges that though section 8(5) of the Workmen’s Compensation Act gives ample discretion to the Commissioner to distribute the compensation awarded among the dependants, this discretion has not been properly exercised. I do not think I can agree with the contention urged by the learned counsel for the appellants. No grounds have been shown as to how exactly the discretion exercised by this Commissioner is wrong or improper. Under section 2(1)(d)(i) of the Workmen’s Compensation Act, the term ‘dependant’ has been defined so as to include the widowed mother. In contradiction to that section 2(1)(d)(ii) says that if a father, a widower, is to be entitled to any part of compensation awarded to his deceased son, he should prove that he was actually dependant. This requirement is not insisted upon in the case of the widowed mother and the Legislature found that it was sufficient to include her in the definition ‘dependant.‘The learned Commissioner seems. to have acted in accordance with the. definition provided for in section 2(1)(d)(i) and has awarded compensation to the widowed mother, who is in law a dependant and who is not required by the Act to prove that she was actually dependant on the deceased son. It is quite clear from her own statement filed before the Commissioner that she did not claim compensation on the basis that she was actually a dependant of the son. She gave out her position very truly and correctly and mi spite of that the learned Commissioner has exercised his discretion and has awarded part of the compensation to the widowed mother. I do not see how this, can be questioned. This appeal has therefore no merits and is dismissed with costs. K.S. ------ Appeal dismissed.
