Only one point was pressed in these OPs. and that was that in a tenant's petition for fixation of fair rent the Rent Court has no jurisdiction to fix a rent in excess of the contract rent. We are unable to accept this contention. What the court has to do is to fix fair rent. The fair rent may be more or less than the contract rent. The two O.Ps. are therefore dismissed but without costs.
