JUDGMENT Mathur, J. - The notices served on Sri B. K. Gupta, Honorary Special Magistrate, and Soni Lal to show cause why they be not punished for contempt of the Court of the Additional Munsif can be discharged, in the case of the Magistrate on the ground that though he did not act in a manner a strict Magistrate would, the orders passed by him were not such as could interfere with the administration of justice by the Additional Munsif or could scandalise the court of the Additional Munsif. He took the precaution not to direct the police to take goods or papers into custody and to produce them before him, nor did he give a direction that the goods and the papers shall be given in the Supurdgi of some other person. If the Magistrate was acting with any dishonest motive or for extraneous consideration, he would have passed different orders. 2. The case as against Soni Lal can be viewed leniently on the ground that the Additional Munsif himself held the attachment to be illegal and set aside the attachment. The apprehensions which were in the mind of Soni Lal and which made him make the complaint, cannot be said to be without jurisdiction. The Munsif has himself noted that the goods under attachment could not inspite of repeated orders be delivered to the defendant of the suit. I am told that the Additional Munsif has already taken action against the Supurdar. A person acting in good faith though acting wrongly does not deserve to be punished. 3. The notices are hereby discharged. Costs on parties.
