JUDGMENT : Das, J. - Defendants are the Appellants. It is the case of the Plaintiff that on 19-8-1950, Defendants 1 and 2 who are brothers jointly borrowed from him 15 Pouties of paddy for their expenses and registered a deed of simple mortgage (Ext. 1), promising to repay the debt within two years with interest at 24% per annum. In spite of repeated demands the Defendants failed to pay anything. Hence the suit by the Plaintiff for recovery of the principal and interest which he claimed only at 9% In terms of money, the Plaintiff? claimed in all. 2. The Defendants admitted the execution of the mort.
