JUDGMENT : Das, J. - The Petitioner has been convicted under Sections 338 and 297, Indian Penal Code and sentenced to undergo R.I. for three months u/s 338. No separate sentence has been passed for his conviction under the latter section. 2. The prosecution case is that the Petitioner was driving a truck on Cuttack Bhubaneswar road in a rash and negligent manner and caused grievous hurt to a cyclist by dashing the truck against him.
