ORDER : 1. We have heard learned counsel for the petitioners and also the learned Attorney-General. We think that there is a clear case of discrimination made out, because there is nothing to show that the cases of these eleven petitioners were distinguished from the case of those who are in receipt of graduate allowance. After giving due consideration to all the circumstances of the case, we are satisfied that equality can only be restored by making an order in the following terms: 'The first respondent, the Delhi Municipal Corporation, do allow to the petitioners as from September 25, 1964 the benefit of the allowance of Rs 20 per month mentioned in the petition in the same manner and for the same periods and on the same conditions as it has been allowed to those who as Lower Division Clerks became entitled to the allowance.' 2. We order accordingly. There will be no order as to costs.
