JUDGMENT 1. - In view of the concession very frankly & candidly made by the learned counsel for the non-petitioners, I do not think it necessary to narrate the facts giving rise to this revision. Suffice it to say that Mr. Mundra has himself stated that the case is covered by the decision in S.B. Civil Revision No. 200/70: State v. Gurdeokaur,decided on 12.7.73 and that the suit out of which this revision arises is triable by a revenue court. 2. Accordingly, I allow this revision application, set aside the order of the learned Munsiff, Bikaner dated 5.12.1969 and direct that the plaint be returned for presentation to the competent revenue court. 3. Let the record of the trial court be sent to the learned Munsiff, Bikaner for returning the plaint to the plaintiff. In the circumstances there will be no order as to costs. *******
