By virtue of the Proviso to section 167 (2) Code of Criminal Procedure 1973 an accused person can not be detained beyond a period of sixty days at the most during the period the case against him is under investigation. The petitioner has therefore to be released on bail provided he is prepared to furnish security of bail or rupees five thousand (Rs. 5000/-) with two sureties of the like amount to the satisfaction of the Chief Judicial Magistrate, Begnsarai.
