JUDGMENT 1. - In this appeal by the defendant tenant only one point for decision, namely, whether the shop in dispute was constructed in 1966 AD. & the suit having been filed in 1969, the provisions of the Rajasthan Premises (Control of Rent & Eviction) Act, 1950, are not attracted. Two other objections were also raised by the defendant in the trial courts namely, that the notice of ejectment was not proper, and the plaintiff Society was not duly registered. These objections were decided against the defendant by the trial Court & the findings of the trial Court in respect of them were not challenged by the first appellate Court. 2. The main objection of the defendant was and still is that the shop in dispute having been constructed in the year 1960, the restriction against eviction laid down in the Act would apply. Both the Courts have concurrently found on the basis of good and legal evidence that the shop in dispute was constructed in the year 1966. This is purely a finding of fact to which no exception can be taken. Consequently, I do not see any force in this appeal & hereby dismiss it, but without any order as to costs. 3. Learned counsel for the appellant prays for grant of some time to enable his client to vacate the shop in dispute. Three months' time is granted during which the appellant shall not be dispossessed through Court. *******
