JUDGMENT In this petition the petitioner who is the owner of the disputed plot of land has challenged the notice issued by the Junior Land Reforms Officer for the purpose of recording the names of Bargadars-respondents in the record-of-rights. It has not been shown that the Jr. Land Reforms Officer has been authorised by any statute to issue notice for such a purpose. In my opinion, Jr. Land Reforms Officer not being authorised cannot give notice for the purpose of recording the names of bargadars in the record-of-rights. I, therefore, set aside the impugned notice and quash the proceedings. The Rule is made absolute to the extent indicated above. But there will be no order as to costs. Liberty is, however, given to the respondents to apply in the proper forum, if there be any, for recording their names as bargadars.
