Short Note : 1. On going through the evidence on record it appears that there was the statement of the doctor (P.W. 1) that he on clinical examination of the complainant found dislocation of elbow joint. In the case of fracture it is settled law that it should be determined exclusively by X-ray examination. In case of dislocation also it was incumbent on the prosecution to conclusively establish it by X-ray examination Muniya v. State of M.P. 1976 M.P. Weekly Notes 26, relied on. Revision partly allowed.
