Short Note : It was an application under section 407 Cr.P.C., for transfer of a Sessions Trial No. 328 of 1975 in which the applicants were the accused persons, from the Court of Shri S.L. Bhargava, Additional Sessions Judge, Alirajpur to any other Court. Held : If may be noted that the first applicant Salimuddin remained present before the trial Court on all the dates on which the case was fixed for hearing. In spite of that the Judge of the trial Court cancelled his bail and took him into custody simply on the surmise that he was also likely to misuse the bail. The explanation of the learned Judge that the applicant Miskanuddin had misused the bail and had caused delay is inconsistent in view of his previous orders whereby he had allowed the application of the said applicant for condonation of his absence, It is, therefore, clear that the act of the learned Additional Sessions Judge in cancelling the bail even during the course of the day when the case was taken up on 23-4-1976 is not at all justified, Thakursingh and others v.
