Short Note : 1. It was an application for review of the order passed by Pandey, J. dated 26th March 1970 dismissing second Appeal No. 18 of 1970 in motion Held: It was argued by the plaintiff-appellant before Pandey, J. that the Additional District Judge misread the evidence of the plaintiff and it was wrongly stated by him that the plaintiff had admitted that the embankment about which the dispute was raised in the suit was demolished in 1958. The mistake made by Pandey, J. was that he thought that the plaintiff claimed damages for demolition of the entire western embankment along Khasra Nos. 341 to 345. The plaintiff's claim related only to the demolition of the western embankment along Khasra No. 341. The plaintiff's case "as that the embankment was demolished in 1961. The plaintiff admitted in paragraph 45 that the other embankment which lay in Khasra Nos 342 to 345 had earlier been demolished in 1958. The plaintiff thus never admitted' that the embankment in respect of the demolition of which he brought the suit was demolished in 1958. His statement was, therefore, clearly misread by the Additional District Judge, Pandey, J. also failed to notice the misreading because he made a mistake about the subject-matter of the claim put by the plaintiff. The error being apparent, a case is made out for review of the order. The order of Pandey, J. dated 25th March 1970 is set aside. The second Appeal No. 18 of 1970 is admitted for hearing parties. Review application allowed.
