Short Note : 1. There have been no proper pleadings as to the establishment of tile right of privacy, the infringement of which is complained, when the defendant contracted the two windows. The demand for legal protection of the right of privacy would emanate from an emotional disturbance in the user by the members of. her family of the property on the ground that they are being watched by the neighbour. It had to be shown that this conduct would per se be offensive and calculated to annoy and induce emotional distress. Factors such as habits of the family, the Purdah observed by them, the fact that such intrusion affected the modesty, dignity and the decency of the persons living in the neighbourhood may have a bearing on the question. The mere assertion that a view of their house was exposed from the windows would not, in itself suffice to establish infringement of this right. This Court would, therefore, reject the case of the plaintiff as far as the right to privacy is concerned. Appeal allowed.
