Short Note : 1. In High Court the case was fixed for final hearing on 18th April 1977. On that date, the learned counsel for the appellant appeared and argued the case fully. It was adjourned to 19th April 1977 for reply on behalf of the respondent. On 19th April 1977 an application was moved on behalf of the appellant praying that the appellant be granted an opportunity to lead additional evidence in the case. 2. Held: In the opinion of this Court the additional evidence sought to be produced is not necessary for the proper decision of the appeal. The accused had the ample opportunity to adduce such evidence as he wanted to do. The application is belated and no reason is shown explaining the delay. The application appears to have been made only with a view to protract the hearing of the case. This Court sees no valid reason for allowing the application. Petition dismissed.
