Ramlal v. State of M. P.

1977-04-28

K.K.DUBE

body1977
Short Note : 1. The Court before proceeding to convict on the evidence of approver must satisfy itself by applying two-fold test. The Court must be satisfied that the approver was a reliable witness, a test common to all witnesses and if the Court was so satisfied, it must proceed to find sufficient independent support to such evidence. The question of applying the second test, however, arises only if the Court was convinced of the reliability of the approver's evidence. Swaran Singh Rattan v. State of Punjab, AIR 957 SC 1637, relied on. Appeal allowed.
