Short Note : The applicant claimed title over the suit property as a Chela of Baba Narayandas who was said to be the last owner of the suit property. The defendants contended that the suit property was gifted by Baba Narayandas in their favour. So far as the question of gift is concerned, the lower appellate Court did not agree with the trial Court which has held in favour of the defendants on this question. However, on the question of plaintiff being the Chela of Baba Narayandas, the finding of both the Courts are concurrent and it has been held that the applicant has failed to prove that he was installed as a 'Chela' of Baba Narayandas. Held : These are concurrent findings of fact and apparently do not raise any question of law for consideration under section 100, CPC. 2. It is no doubt true that both in the trial Court as well as before the learned lower appellate Court, the applicant was permitted to use and appeal as pauper. However, considering the grounds which the applicant seeks to urge in support of the proposed appeal I find that the application is without any substance and hence it must be dismissed. Application dismissed, but the applicant granted one month's time to pay requisite Court-fees if he so desires.
