Short Note : 1. It appears that the learned trial Court relied upon the testimony of the complainant Mithulal (P.W.2) and Babulal (P.W.5). Even the complainant (P.W.2) was declared hostile by the prosecution and his committal Court statement (Ex. P-3) was tendered under section 288 Cr.P.C. The witness Babulal (P.W.5) was also declared hostile and his committal Court Statement (Ex. P-5) was tendered in evidence under section 288 Cr.P.C. A perusal of the statement of these hostile witnesses would show that they have given contradictory statement on material facts. In these circumstances, it would not be wrong to say that they are unreliable witnesses. As for the tendering of the committal Courts statement the settled law is that before placing reliance on it, there must be some independent evidence to corroborate. In the instant case there does not appear to be independent evidence to corroborate. Sharnappa Mutyappa Halka v. State of Maharashtra, AIR 1964 SC 1357 , Muluwa v. State of M.P., AIR 1976 SC 989 , relied on. Appeal allowed.
