Sundariya v. State of M. P.

1977-07-14

J.S.VERMA, N.C.DWIVEDI

body1977
Short Note : In view of the false explanation furnished by the appellant, in view of the extra judicial confession made by her and in view of her unusual conduct, the only reasonable conclusion is that the appellant who had an illegal conception, delivered a child, killed it and bid the dead body under leaves. Thus the circumstances established against the appellant and denied by her can only be explained on the ground that the appellant was the killer of her child and therefore, she had concealed the dead body under the leaves, left it there and had suppressed its birth. This Court is therefore of the view that the evidence conclusively connected the appellant with the murder of the child and she was rightly convicted under sections 302 and 318 of the I.P.C. Appeal dismissed.
