Short Note : By order dated 15-11-76 in civil suit No. 9-A of 74, the District Judge, Rewa has determined the value of the suit property to be Rs. 55,377.40 nps. The details of the valuation are given in para 15 of the order. The plaintiff has a grievance about item No.1, i.e. house No. 8/34 which has been valued at Rs. 30,000/-. The plaintiff contends that since the learned Judge had accepted the valuer's estimate in respect of the other four items, there was no reason why his estimate for house No. 8/34 should have been discredited. According to the valuer, the house was worth Rs. 11,552/- and could at the most be valued at Rs. 14,565/-. Held : The learned Judge has gone by the valuation given by the plaintiff in an earlier suit filed in 1964. The house was shown to be worth Rs. 30,000. But in accepting that valuation, the Court overlooked the statement of the valuer that the house was old and had deteriorated in the meantime. 2. It would be reasonable to accept the valuer's present estimate can expert in the field rather than on what the plaintiff estimated in 1964. I would therefore, interfere and modify the valuation shown in para 15, by substituting Rs. 14,565/- for Rs. 30,000/-. Revision allowed.
