Short Note : 1. It was an appeal against acquittal of the respondent of an offence under section 34 (a) of the M.P. Excise Act on the allegation that he was in possession of seven bottles of liquor without the requisite permit. The respondent admitted being in possession of the same and produced a permit in his favour for six bottles of liquor. The trial Court came to the conclusion that six bottles of liquor were covered by the permit and possession of the remaining one bottle was not an offence, since that was within the permitted limit which a person could have in his possession without a permit. There is thus no ground to interfere with the acquittal of the respondent. Appeal dismissed.
