Short Note : 1. The accused was charged under sections 409, 420, 467, 468 and 471. The trial Court acquitted him for offences under sections 420 and 468 IPC, but convicted under sections 409, 467 and 471. The plea of the accused was that as he has been acquitted for the offences under sections 420 and 468, i.e., for cheating and using a fabricated document for cheating, the appellants conviction under sections 409, 467 and 471 IPC cannot be sustained because the entire prosecution case is based on the forged documents. Held : The Offences of criminal breach of trust under section 409, that of fabricating a document under section 467 and fraudulently using a forged document as genuine are all distinct offences from those of cheating under section 420 and using a forged document for cheating under section 468, IPC. Even if there is an acquittal for cheating under section 420 and also under section 468, the appellant could still be convicted for the aforesaid three distinct offences when it has been proved beyond all doubt that the appellant as a public servant as Sub-Post Master forged a document and on the basis of this document withdrew an amount Rs.10,000 from the savings bank account of one depositor and thereafter committed criminal breach of trust in respect of this amount. Appeal dismissed
