Short Note : 1. This revision is directed against an order passed in Civil Suit No. 169-A of 1973 by which the Civil Judge Class II, Murwara vacated an earlier order by which the suit was stayed pending the disposal of Civil Suit No. 9-A of 1974, which is being tried by Civil Judge Class I, Murwara. 2. Civil Suit No. 169-A of 1973 in which this revision arises has been filed by the plaintiff-non-applicant for ejectment of the defendants-applicants on the ground that they are tenants. Civil Suit No. 9-A of 1974 has been filed by the applicants, or a declaration that they are in possession as owners. The parties in the two suits are the same. 3. Shri R.P. Verma, who appears for the applicants, and Shri L.P. Sanghi, who appears for the plaintiff non-applicant, agree that both the suits should be tried by the same Court and should be decided on the same date to avoid any conflict Held : In view of the stand taken by the learned counsel for the parties in this Court, I transfer Civil Suit No. 169-A of 1973 from the file of Civil Judge Class II, Murwara, to the file of Civil Judge Class I. Murwara, where Civil Suit No. 9-A of 1974 is pending. I also direct that both the suits shall be finally decided on the same date by the Civil Judge Class I, Murwara. The Civil Judge shall decide both the suits as early as possible and real effort shall be made by him to decide them within six month.
