Short Note : 1. The only question for consideration was whether the conviction could be sustained on the basis of the extra-judicial confession alleged to have been made by the appellant and which had been retracted by him in his statement in the Court. 2. It is the settled law that extra-judicial confession is a very weak type of evidence and it will be much more so if it is retracted and unless there is an independent corroboration it would not be safe to rely on such evidence. Appeal allowed.
